TERMS AND CONDITIONS — ZADSMART SDN BHD

1. Definitions
“Company” refers to Zadsmart Sdn Bhd.
“Client” refers to any individual, company, or organization engaging the Company’s services.
“Services” refer to all cleaning and maintenance works including but not limited to Specific Cleaning, General Cleaning, Landscaping, and Pest Control.

2. Acceptance of Terms
By confirming any booking, signing a quotation, or allowing service commencement, the Client acknowledges and agrees to be legally bound by these Terms and Conditions.

3. Scope of Work
3.1 The Company shall perform Services in accordance with the agreed quotation, service description, and schedule.
3.2 Any additional work requested outside the approved scope shall be subject to additional charges and availability.
3.3 The Company reserves the right to decline requests that fall outside operational capabilities or safety standards.

4. Payment Terms
4.1 Full payment shall be made according to the agreed quotation or invoice issued by the Company.
4.2 The Company reserves the right to suspend or withhold services in the event of non-payment or delayed payment.

5. Strict No Refund Policy
5.1 All payments made are strictly non-refundable once the Services have been carried out or partially completed.
5.2 This policy applies due to the allocation of manpower, logistics, operational preparation, and service execution costs incurred by the Company.

6. Service Warranty & Rectification
6.1 The Company provides a limited service warranty to ensure customer satisfaction.
6.2 If the Client is dissatisfied with the completed Services, the Client must notify the Company within a reasonable timeframe after service completion.
6.3 The Company will assess the claim and, where deemed reasonable, provide corrective action within the original service scope.
6.4 The warranty does not cover:

  • Requests beyond the agreed scope of work

  • Issues caused by third parties or environmental conditions after service completion

  • Normal wear and tear or pre-existing conditions

7. Client Obligations
7.1 The Client shall provide safe access to the premises, utilities if required, and a hazard-free working environment.
7.2 The Client must inform the Company of any fragile items, special materials, or risk factors prior to service commencement.
7.3 The Company shall not be held liable for damages arising from undisclosed risks or unsafe conditions.

8. Rescheduling and Cancellation
8.1 Any request to reschedule must be communicated in advance and is subject to the Company’s availability.
8.2 Last-minute changes or cancellations may incur additional charges at the Company’s discretion.

9. Limitation of Liability
To the fullest extent permitted by law, the Company shall not be liable for indirect, incidental, or consequential losses arising from the use of its Services. Liability, if any, shall be limited to the value of the service provided.

10. Force Majeure
The Company shall not be responsible for delays or failure to perform Services caused by circumstances beyond its reasonable control including but not limited to natural disasters, government restrictions, or unforeseen operational disruptions.

11. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of Malaysia.

12. Amendments
Zadsmart Sdn Bhd reserves the right to update or modify these Terms and Conditions at any time without prior notice. The latest version published shall prevail.
